Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and nbdomains LLC, a Kentucky limited liability company ("we", "us"). nbdomains LLC is the parent company and operator of Fovar — the Fovar mobile application and the fovar.app website (together, the "Service").
This document is published at nbdomains.com/terms by nbdomains LLC as the operating entity. It was previously published at fovar.app/terms; the substance is unchanged by the move.
By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

1. What Fovar is, in plain language
Fovar is a tool for a small group of people who put money together. A church youth group, a ladies' circle, a hometown association, a few friends who help each other when something goes wrong.
Your group contributes. Everyone can see the balance. Money only leaves when a second person agrees.
Read this part carefully, because it is the most important thing in these Terms:
- Fovar is not a bank. We do not take deposits, we pay no interest, and nothing in your group's balance is insured by the FDIC or anyone else.
- Fovar is not a lender, an investment service, or a charity.
- Fovar does not run your group. We do not decide who joins, what the money is for, who gets helped, or whether a decision was fair. Those are your group's decisions and your group's responsibility.
- The money belongs to your group, not to us.
2. Definitions
- Group — the people using a shared treasury together.
- Member — anyone with a Fovar account who belongs to a Group.
- Account Holder — the one adult who completes identity verification with Stripe and in whose name the payment account exists. See §4. Called the leader, treasurer or president in the app.
- Treasury — a Group's shared balance and the record of its contributions and spending.
- Fund — a named pot inside a Treasury.
- Contribution — money a Member puts in.
- Co-Sign Rule — the requirement that a second person approves a withdrawal before it executes. See §6.
3. Who may use Fovar
You must be at least 13 years old to hold a Fovar account.
You must be at least 18 years old to:
- be the Account Holder for a Group;
- connect a payment account;
- receive, withdraw, or spend any of a Group's money.
If you are between 13 and 17, you may hold an account, join a Group and contribute with the permission of a parent or guardian, who is responsible for your use of the Service and for any Contribution you make.
This means a Group made up of people under 18 needs a participating adult — a youth leader, parent or guardian — to be the Account Holder. This is not a Fovar policy we could waive: no regulated financial institution will open an account for a minor or for an informal group.
We may require proof of age at any time and will suspend accounts that misrepresent it. Creating an account for someone under 13 violates these Terms.
You must also be a United States resident with a US bank account.
4. The Account Holder — please understand this before you start
Your Group is not a company. It has no tax ID and no registration, and that is fine — Fovar is built for exactly that. But an informal group cannot legally hold a financial account. Somebody real has to.
So one adult Member becomes the Account Holder. When they set up payouts:
- They complete identity verification with Stripe, on Stripe's own website, using their legal name, date of birth, address and Social Security Number.
- Fovar never sees that information. It goes to Stripe. We receive only a reference number and a yes-or-no answer.
- The payment account is legally in the Account Holder's name, because the Group cannot hold one.
4.1 What this means, stated plainly
If you are the Account Holder:
- You are the person Stripe holds responsible for the account.
- Money moving through it may be reportable in your name. Fovar does not give tax advice. If your Group handles meaningful sums, talk to an accountant.
- You are responsible for keeping your login and your device secure.
If you are a Member and not the Account Holder:
- You are trusting a specific person in your Group, and you should know which one. The app shows you.
- Fovar's Co-Sign Rule limits what that person can do inside the app. It does not change whose name is on the account. See §6.3.
4.2 When the Account Holder leaves
A payment account cannot be handed to someone else. If your Account Holder leaves, a new adult must complete verification and the balance must be moved. Plan for this before it happens. We will help you move a balance; we cannot transfer an identity.
5. Money coming in
5.1 How it arrives
- Bank transfer (ACH). You link your bank through Plaid. You type your bank login into Plaid's own screen — never into Fovar. We never see your online banking credentials, your full account number or your routing number.
- Card or wallet, through Stripe.
- Cash, which a Member declares and an Account Holder confirms. Fovar records it; Fovar never touches it.
5.2 Contributions are held before they can be spent
A bank transfer is not final when it appears. Your bank can reverse it — within about two business days for insufficient funds, and for up to 60 days if someone disputes the debit as unauthorised.
So Fovar holds new bank contributions as pending for a short period (normally five days, set by your Group) before they count as spendable. Your Group's balance shows all three figures: what is pending, what is spendable, and how much of the spendable amount is still inside the 60-day reversal window.
This is deliberate. A Group that spends money which later bounces ends up overdrawn with nobody to bill.
5.3 Contributions are not refundable by Fovar
A Contribution is money you gave your Group. Once it settles we cannot pull it back out of your Group's balance and return it to you.
If you want your money back, ask your Group. They can send it to you like any other withdrawal. Fovar will not adjudicate that request.
We can reverse a Contribution before it settles, and we will act on a genuine error or an unauthorised debit — contact support@nbdomains.com.
5.4 Plans and fees
Plans are priced by how many Members your Group has:

The Free plan is genuinely free — there is no trial and no card required. We take 1.5% of what your Group collects instead. On a paid plan we take nothing from Contributions.
Every plan includes the Co-Sign Rule. We will not put a safety control behind a price.
5.5 Processing fees
Separately from Fovar's fee, Stripe charges for moving the money:

Bank transfer is much cheaper for your Group — on a $200 contribution it is $1.60 rather than $6.10. We show both before you choose.
5.6 Who pays the fees
When you contribute, you can cover the fees yourself so your Group receives the full amount you intended. If you do not, the fees come out of the Contribution and your Group receives the remainder.
Either way, the app shows you both numbers before you confirm — what you pay and what your Group receives. There are no fees you find out about afterwards.
5.7 Refunds of fees
Fovar's platform fee and Stripe's processing fee are not refunded if a Contribution is later reversed, because the processing has already happened and Stripe has already charged us.
5.8 Changing plans and prices
Your Group can change plan at any time. If your Group grows past your plan's member limit, we will tell you in the app before anything changes.
We may change prices or fees. We will give you at least 30 days' notice in the app or by email, and you may cancel or change plan before it takes effect.
6. Money going out — the Co-Sign Rule
6.1 How it works
- A Member requests a withdrawal.
- A second person backs it.
- The required number of officers approve it.
- Fovar executes it and records it in the ledger.
The person who requested it cannot approve their own request.
If anyone changes the amount, the fund or the destination after signatures have been given, every signature is voided and approval starts again.
6.2 What the Co-Sign Rule protects against
One person acting alone. That is the whole of it, and it is genuinely valuable — it is the difference between Fovar and a shoebox with one keyholder.
6.3 What the Co-Sign Rule does NOT protect against
We would rather be honest about the limits, because a control you misunderstand is worse than no control at all:
- It does not stop two people who agree with each other. If the required officers all want to move money for a bad reason, the rule permits it. Fovar cannot tell a legitimate withdrawal from a dishonest one.
- It cannot know whether a purpose is honest. A withdrawal described as "supplies" that buys something else will still execute if the officers sign it. The ledger records what happened; it does not audit why.
- It is a rule inside our software, not a legal restriction on the Account Holder.
Choose your officers accordingly. Fovar gives your Group a tool. It cannot give your Group trustworthiness.
6.4 If you are being asked to join a Group
If someone invites you to put money into a Fovar Group, you are trusting them and the other officers — not Fovar. Look at who the Account Holder is. Look at the ledger, which shows every movement and cannot be edited. Ask your questions before you contribute, not after.
6.5 Where an approved withdrawal goes, and how fast
An approved withdrawal is transferred to an external bank account in the Account Holder's name, connected through Plaid. Fovar does not issue your Group a bank account, and money never leaves the Group's balance to anywhere else.
You choose the speed at the point of withdrawal:

Instant is not always available. It depends on the receiving bank and on Stripe, which can withdraw eligibility from an account at any time. Where it is unavailable the option is not offered, and Standard is unaffected.
We do not guarantee a delivery time for either, and we cannot pay out money still pending under §5.2. Paying for Instant does not shorten the 60-day window in §5.2 — it moves money that was already spendable, sooner.
7. The ledger, and what everyone can see
Every Contribution and every withdrawal creates a ledger entry.
The ledger cannot be edited or deleted — by you, by your officers, or by us. A correction is a new entry that reverses the old one, and both stay visible. This is enforced by our database, not by policy.
That permanence is the point. It is what lets a Member trust a balance they did not personally count.
Whether the ledger shows who paid, or only how much, is your Group's choice. It is off by default, because making non-payment visible to everyone is a social decision a Group should make deliberately rather than inherit.
8. Your responsibilities
You agree not to:
- use Fovar for anything unlawful, or to move the proceeds of anything unlawful;
- use it for gambling, lending at interest, investment schemes, or anything promising a financial return;
- collect money for a purpose you do not intend to honour;
- misrepresent who you are, or set up a Group to take money from people you intend to mislead;
- pressure or deceive anyone into contributing;
- move money for someone else in a way designed to conceal its source;
- attempt to circumvent the Co-Sign Rule or any limit;
- probe, scrape or attack the Service.
Fovar is for groups whose members know each other. It is not a payment processor for strangers, and using it that way violates these Terms.
9. Fraud and misuse of a Group's money
We take this seriously and we will act.
If we believe a Group's money is being misappropriated, we may freeze withdrawals, suspend accounts, or close a Treasury while we look into it, including without notice where waiting would make things worse.
But understand what we can and cannot do. We can see the ledger. We cannot know whether your Group agreed to a payment, whether a purchase was legitimate, or who is telling the truth. We do not adjudicate disagreements between Members and we will not decide who is right.
If money has been taken from your Group dishonestly, that is a matter for the police and the courts. We will cooperate with lawful requests and provide records.
10. Disputes inside a Group
Groups fall out. Officers leave. People disagree about what money was for.
Fovar is not a party to any of it. We provide a ledger and a set of controls. We do not:
- decide who owns a Group's balance;
- decide whether someone should be removed;
- reverse a payment because a Member disagrees with it;
- take sides, arbitrate, or mediate.
If your Group splits and cannot agree, the money stays where it is until the people with authority in the app move it. We will not move it for you, and we will not freeze it on one Member's say-so without evidence of unlawful conduct.
We know that is unsatisfying. It is the honest position, and pretending otherwise would be worse.
11. How your money is held
Fovar uses Stripe to move and hold money, and Plaid to connect bank accounts. Your use of the Service is also subject to Stripe's and Plaid's own terms.
Your Group's money is held in a Stripe account belonging to your Group's Account Holder — not by Fovar. We do not take possession of your Group's funds. We provide the software that instructs Stripe to move money on your Group's behalf, and we can see the balance; we do not hold it.
Fovar is not a bank and does not take deposits. Your Group's balance is not a bank account. It is not FDIC-insured. It earns no interest.
If Fovar were to shut down, your Group's money would still be in your Account Holder's Stripe account and they could withdraw it directly through Stripe.
12. Availability
We try to keep Fovar running and we do not promise it always will. We may take it down for maintenance, and we may disable a feature — including remotely, without an app update — where we believe there is a problem.
Nothing in the Service should be your only record of what your Group owns. You can export your ledger, and we recommend you do.
13. Suspension and termination
You may stop using Fovar at any time and can request account deletion in the app.
We may suspend or close an account that violates these Terms, that we believe is being used unlawfully, or where we are required to.
Closing your account does not remove your entries from a Group's ledger. See §7 and our Privacy Policy — that record belongs to the Group as much as to you.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PARTICULAR PAYMENT WILL COMPLETE.
We specifically make no warranty about the conduct of the people in your Group. We do not vet Members, verify what a Group says it is collecting for, or guarantee anyone will use the money as promised.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER NBDOMAINS LLC NOR ITS OFFICERS, MEMBERS OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA OR LOSS OF GOODWILL.
WE ARE NOT LIABLE FOR MONEY LOST BECAUSE OF THE CONDUCT OF PEOPLE IN YOUR GROUP — including an Account Holder who withdraws dishonestly, or officers who approve a withdrawal you disagree with.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) THE TOTAL PLATFORM FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) ONE HUNDRED US DOLLARS ($100).
Some states do not allow certain limitations, and to that extent they do not apply to you.
16. Indemnity
You will indemnify and hold harmless nbdomains LLC against any claim, loss or expense arising from your use of the Service, your breach of these Terms, or a dispute between you and anyone in your Group.
17. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Madison County, Kentucky, and you consent to that jurisdiction.
Before filing anything, email support@nbdomains.com. Most problems can be sorted out directly, and we would rather sort them out.
18. Changes to these Terms
We may update these Terms. If a change materially affects you we will notify you in the app or by email before it takes effect. Continuing to use the Service after that means you accept the change.
19. General
If any provision is unenforceable, the rest stands. Our not enforcing something is not a waiver of it. You may not assign these Terms; we may assign them to a successor. These Terms and the Privacy Policy are the entire agreement between us.
